Mediation Domains

Under the Law no. 192/2006 amended by Law no. 370/2009, parties may initiate the mediation procedure:

  • In any civil proceedings;
  • In any commercial litigation;
  • Family disputes: disputes between spouses on the continuation of marriage, exercise of parental rights, children's home setting, parental contribution to child support and any other disputes that arise in relations between spouses on the rights they may have by law question about divorce and its ancillary applications;
  • Consumer Protection: if the consumer alleges injury due to purchase of defective goods or services, the non-contract terms or guarantees provided, the existence of unfair terms contained in contracts between consumers and businesses or the infringement of other rights under national law or EU Consumer;
  • In relation to conflicts of law in labor disputes;
  • Criminal law: for offenses where the law provides that criminal liability is removed by withdrawal of preliminary complaint or reconcilliation of the parties.

Mediation may cover all or part settlement of the dispute.

Law no. 370 of November 26, 2009 brings major changes to the Mediation Act (No. 192/2006). Under this law, beginning on March 3, 2010, magistrates are required to inform parties about the mediation procedure and to guide the parties to resort to resolution of disputes outside courtrooms.
